1. Services

AussieTech provides managed IT services including helpdesk support, security monitoring, incident response, maintenance windows, patching, vendor management, and service-ticket communications. Service usage is governed by these Terms and applicable Master Services Agreements, Statements of Work, Orders, or Acceptable Use Policies.

2. Eligibility & Account

Users represent they are authorized to bind their customer entity. Users remain responsible for credential security across portals, RMM/PSA tools, and ticketing systems.

3. Acceptable Use

Services cannot be used to violate law, transmit malware or spam, attack networks, or infringe intellectual property rights. The company may suspend or rate-limit traffic posing security threats or degrading performance.

4. Scheduling; Maintenance; Incidents

Planned maintenance windows may occur. Notices regarding outages, security events, tickets, approvals, and maintenance scheduling may be sent via SMS, email, and in-portal alerts.

5. Fees & Payment

Fees and payment terms appear in Service Documents. Disputed invoices must be raised in writing within 10 days of receipt.

6. Disclaimers; Availability

Services are provided with commercially reasonable skill and care. However, wireless carriers do not guarantee SMS/MMS delivery and are not liable for delayed messages. Network or vendor outages may occur.

7. Limitation of Liability

Neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Aggregate liability is limited to amounts paid for affected Services during the preceding 12 months.

8. SMS Program Terms (A2P 10DLC)

Program Description: With consent, AussieTech sends informational text messages including ticket updates, appointment reminders, incident notifications, system status alerts, account notices, and MFA prompts. Message frequency varies by activity; standard message and data rates may apply.

Opt-In Methods:

  • Submit a web form with mobile number and consent checkbox
  • Sign a Service Document listing SMS as a contact method
  • Text a provided keyword

Opt-in must specifically cover text messages.

Confirmation Message:“Aussietechinc: You’re subscribed to service texts (tickets, alerts, notices). Freq varies. Msg&data rates may apply. Reply STOP to opt out, HELP for help.”

Opt-Out: Reply STOP to unsubscribe. We confirm opt-out and stop sending texts except legally required notices. You may also email info@aussietechinc.com for removal.

Resubscribe: You may rejoin by texting UNSTOP/START or re-opting in through available forms.

Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.

Consent & TCPA: Appropriate consent is obtained before sending automated texts. Marketing texts require prior express written consent; informational texts require prior express consent. Users may revoke consent anytime using STOP or by contacting us.

Eligibility: Must be the account holder or have account holder permission.

9. Privacy

Personal data is handled per the Privacy Policy. SMS processing includes phone number, opt-in status, timestamps, messaging metadata, and content necessary for program delivery and support logs.

10. Intellectual Property

All platform, portal, and content rights remain with AussieTech and its licensors.

11. Governing Law; Disputes

These Terms are governed by Florida law without regard to conflict of law provisions. Disputes fall under exclusive jurisdiction of Florida courts.
